Vendor Terms & Conditions

Entering Premises:

  • You must report to the site office.
  • By Entering Emerald Auction Centre Yard, you do so at your own risk.
  • Emerald Auction Centre take no responsibility for any damage to property or personal injury during the delivery of items for auction. All items delivered to Emerald Auction Centre are at your own risk.

Auction Details:

  • You must register to bid and by doing so you acknowledged the terms and conditions of Emerald Auction Centre, As set out here.
  • All lots are sold GST inclusive or unless otherwise stated. If the vendor is not registered for GST this will show on the purchaser’s tax invoice. 
  • 10% Buyers Premium exclusive GST will be added to the knock down price to form the total sale price.
  • Invoices will be emailed at the completion of the auction.
  • Full payment must be received within 24 hours following the completion of the auction. Cash, Eftpos, credit card, cheque, direct deposit.
  • If finance is being arranged please notify Emerald Auction Centre accounts for any further requirements. 
  • All items must be paid for before leaving the yard. No Items will be removed from site until full payment has been received.
  • All items purchased are the buyer’s responsibility on the fall of the hammer.
  • All items remain the property of the vendor until full payment has been received by Emerald Auction Centre.
  • All lots catalogued are available for viewing and Emerald Auction Centre encourages you do so.
  • Any faults in the goods sold shall not void the sale, but neither the Vendors nor the Auctioneers shall be bound to deliver more than is in their possession.
  • All lots are sold as is, where is, without any warranties of any kind. All vehicles are sold unregistered unless stated and do not have statuary warranty. 
  • Emerald Auction Centre will not be liable for any loss, damage, cost or expense suffered or incurred by the Purchaser arising from the purchase of an item at the Auction.
  • You can seek professional services to help with your decision in your possible purchase, and do so at your own risk.
  • The Auctioneer may refuse to accept a bid and can withdraw any lots from sale. 
  • Where a bid has been referred the auctioneer has the right to negotiated with only the highest bidder on the item. Subject to vendors approval.
  • The highest bidder will be the Purchaser, subject to Vendor acceptance, but if any dispute arises as to the last or highest bidder, the Auctioneer may have discretion to put the lot in dispute up again and resold.
  • Ownership of an asset will not transfer to the purchaser until full payment has been received into the Emerald Auction Centre Trust Account.

Collection of Items:

  • You must report to the site office.
  • No Vehicles will be allowed on site until after the last lot is sold.
  • All items must be paid for before leaving the yard. No Items will be removed from site until full payment has been received.
  • Emerald Auction Centre and RBV Rural take no responsibility for any damage to property or personal injury during the collection of items from the auction. 
  • All items purchased and paid for are to be removed from Emerald Auction Centre within 2 weeks following close of auction, during business hours. All items not collected by this time will be deemed abandoned and will either be resold or disposed of, with any monies paid can be forfeited.
